Protection status of the
whale shark The whale shark is present in
several international protection lists. It is in Appendix II of the
Convention on International Trade in Endangered Species of Wild Fauna
and Flora (CITES)
where strict control of the species is suggested to avoid its
extinction. Bonn
conventionxon
the Conservation of Migratory Species applies to the whale shark,
considering that it can benefit from international agreements for its
management. It is considered vulnerable under the red list of International Union for Conservation of Nature and Natural Resources (IUCN). This species is also on the list of transzonal and highly migratory fish species under risk, that require conservation policies, according to (UNCLOS). Mexico, as a contracting part of Convention
on Biological DIversity established at the 1992 Rio Earth
Summit, is committed to promote the biodiversity and the sustainable, equitable
and fair use of the benefits it produces. In the 1995 conference, the
Jakarta Mandate was created regarding coastal and marine biodiversity
where the world-wide consensus was achieved regarding the importance of
these habitats. Simultaneously, within Mexico the whale shark is
considered threatened by NOM-059-SEMARNAT-2001
for environmental protection - native species of wild Mexican flora
and fauna - risk categories and specifications for inclusions,
exclusions and changes to the under risk species list. The
non extractive activity that takes place with the whale shark population
is regulated by articles 99, 100 and 101 of the
General Wild Life Law.
